-Judge Weldon Korir says it is not reasonable to summon Health CS

-His ruling follows a request by Law Society of Kenya to have CS Mutahi summoned for failing to compile contingency report on virus.

The High Court has declined to summon Cabinet Secretary for Health Mutahi Kagwe to appear before them to explain the measures government has taken to handle the Covid-19 pandemic.

This orders comes after lawyers from the Law Society of Kenyan sought to have Mutahi summoned for failing to present a constructive report in court on how to handle the situation.

However while giving a ruling on Thursday, Judge Weldon Korir said he does not find a reasonable basis to summon the Cabinet Secretary at this time when the country is at war with the disease.

“We must all appreciate that at the moment we are at war, and the man leading Kenyans in fighting that war is the President , back to back supported by Health Cabinet Secretary. I do not find it accountable to summon a person leading the fore front to come to court,” he stated.

On February 28 Justice James Makau gave an order to the State to give a report on how they are prepared as well as tracing and re-examine a;; the 239 passengers that were let into the country aboard a Chinese flight.

Judge Korir who conducted a proceedings at the Milimani Parking lot, stated that the next proceeding will be on Thursday next week.
